offenses all the time. You are innocent unless and until you are proven guilty. You are owed that<br />
presumption of innocence here in the United States, but often times you need an attorney to help you<br />
enforce your rights.</p>
<p>When you are charged with a crime it can be overwhelming. The process can be very confusing. If<br />
you have recently been arrested you may be sitting here wondering “What comes next?” It can be a<br />
frightening experience. You may be worried about whether you may go to jail, whether you may lose<br />
your license, whether you may lose your job. These are often times very valid concerns. When you<br />
have been arrested and need answers to your questions it’s time to get an attorney. Attorney Marc D.<br />

<p>Emmanuel Pina and Sandro Tavares were convicted on Thursday in Suffolk Superior Court on two counts of murder each for their roles in the August 2009 shooting outside Ka&#8217;Carlos Bar and Grill in the city&#8217;s Dorchester neighborhood.</p>

<p>The shooting stemmed from a confrontation earlier inside the restaurant.</p>

<p>Prosecutors say once outside, Pina shot at Jovany Eason, but the bullet missed and went through the restaurant&#8217;s window, hitting 47-year-old chef Manuel Monteiro in the chest, killing him.</p>

<p>Authorities say Pina then continued firing at Eason, striking him several times.</p>
</div>
<p>Both men face mandatory life terms without the possibility of parole at sentencing Tuesday.</p>

<p>Richard Vitale, who in June was acquitted in an unrelated federal corruption case involving DiMasi, is accused of failing to register as a lobbyist for ticket brokers trying to change the state&#8217;s anti-scalping laws, and of making campaign contributions to legislators that exceeded the $200 limit for lobbyists. Prosecutors also said Vitale negotiated an illegal &#8220;contingency&#8221; fee to be paid by the brokers if the legislation they were seeking was passed.</p>
<p>Vitale pleaded guilty to seven misdemeanor charges in Suffolk Superior Court. His consulting firm, WN Advisors, also pleaded guilty to three lobbying violations.</p>
<p>Vitale, 66, will not serve any jail time but was fined the maximum $32,000 and given two years&#8217; probation by Judge Carol Ball. The sentence also prohibits him from lobbying for the next three years. A separate agreement with prosecutors requires him to give up the $60,000 he received from the Massachusetts Association of Ticket Brokers in 2007 and 2008.</p>

<p>As of July, 2003, Massachusetts has a &#8220;per se&#8221; DUI/ OUI law, under which you are considered Driving Under the Influence if your blood alcohol ratio (BAC) is over .08. In Massachusetts, most simple first offender DUI charges are handled as &#8220;alternative disposition&#8221; probation plea bargains, under which you participate in a mandatory drug-alcohol education program, and your license is temporarily suspended.</p>
<p>Dui First Offense Penalties:</p>
<p>Jail: Not more than 2 1/2 years House of Correction<br />
Fine: $500-$5,000<br />
License suspended for 1 year; work/education hardship license considered in 3 months; general hardship in 6 months.<br />
Alternative disposition (1st Offense OUI)</p>
<p>Probation based on a plea bargain of the criminal DUI charge above.<br />
Mandatory participation in alcohol-drug education program paid for by defendant.<br />
License suspended for 30 days (210 days for drivers under age 21)<br />
License Suspension:</p>
<p>· A breath test of .08 for operators over age 21 (or .02 for operators under age 21) incurs a 90 day suspension. This suspension terminates at 90 days or with the disposition of the case, whichever is earlier. For a first offense OUI charge (over age 21), the license suspension period has recently decreased from 90 to 30 days. If you plea bargain to the criminal DUI charge, you will receive no more than a license suspension of 30 days.</p>
<p>Refusing the Breath Test:</p>
<p>If you refused the breathalyzer, you will automatically lose your license for 180 days for the first refusal offense. Under Massachusetts DUI law you have no right to an attorney after being asked to take a field sobriety test.</p>
<p>If you refused to take a breath or blood test after being arrested in Massachusetts, or if the results of your test were .08 blood alcohol content (BAC) or above, your license will be suspended 15 days after the arrest, unless you take action to demand an administrative hearing within 30 business days after the arrest.</p>
